Error in the deed of trust – I can close?
I sold a property for several years, however, the part I sold it to me has refused to pay the loan it funds. I waited over two years and I'm tired of excuses. I made a note and a deed of trust as the moment of the sale. However, the new owners stated that there is an error in the deed of trust. It lists the lot number wrong and if I try to close they would sue me. I heard about judicial foreclosures, but are very expensive and take forever. 1) The APN #, address and description of the batch are correct. Is that enough to seize? Will I have problems due to an error in the batch number? I have asked to sign a corrected deed of trust and refuse. Thanks! (Jurisdiction California)
If you want to fight based on the batch number, it will be difficult, there is no way to avoid that.
